How do I check LLC name availability in Texas?

Search the Texas Secretary of State's online database at https://www.sos.state.tx.us/corp/sosda/index.shtml. Your LLC name must be distinguishable from all existing entities on file (Tex. Bus. Org. Code § 5.053) and include a required designator: Limited Liability Company, LLC, or L.L.C. The search is free and immediate. If available, you can reserve the name for 120 days by paying a $40 fee.

Searching the Database

Access the Secretary of State's business search tool 24/7 at no cost. Enter your proposed LLC name and review all results carefully. The name must be distinguishable from any existing entity name on file—this includes corporations, LLCs, partnerships, and sole proprietorships. Search for exact matches and similar variations to ensure your name will pass the distinguishability requirement.

Required Name Designator

Your LLC name must include one of these designators: "Limited Liability Company," "LLC," or "L.L.C." (Tex. Bus. Org. Code § 5.054). This designation must appear in your Articles of Organization and is non-negotiable.

Restricted Words

Certain words require additional approval and cannot be used without meeting statutory exemptions:

  • Bank
  • Trust
  • Insurance
  • University
  • College

If your desired name contains any of these terms, contact the Texas Secretary of State at (512) 463-5555 to determine eligibility and required documentation.

Name Reservation

Once you confirm availability, you can reserve your name for 120 days by filing a Name Reservation application with the Secretary of State. The reservation fee is $40. This protects your chosen name while you prepare your Articles of Organization and gives you time to complete the formation process.

Operating Under a Different Name

If your LLC will operate under a name different from its legal entity name, you must file a DBA (Doing Business As) with the Texas Secretary of State using Form 503. The DBA filing fee is $25.
