How to Get an EIN for Your Florida LLC

An EIN is issued by the IRS, not Florida. File your Articles of Organization with the Florida Division of Corporations first under Fla. Stat. § 605.0201 ($125 fee). Once approved, apply for your EIN directly with the IRS online at irs.gov, by phone at 1-800-829-4933, or by mail using Form SS-4. Online applications receive instant approval.

Step 1: Form Your Florida LLC

File Articles of Organization with the Florida Division of Corporations at https://dos.fl.gov/sunbiz/. Your filing must include:

  • LLC name with required designator (LLC, L.L.C., or Limited Liability Company)
  • Principal office street address
  • Registered agent name and Florida street address
  • Written acceptance from your registered agent

The filing fee is $125.00. File online for faster processing. Verify your name is distinguishable using https://search.sunbiz.org/.

Step 2: Apply for Your EIN with the IRS

Once your Florida LLC is approved, apply for your EIN directly from the IRS using Form SS-4:

Online (Fastest): Visit irs.gov and complete Form SS-4. Approval is instant.

Phone: Call 1-800-829-4933. The IRS will issue your EIN immediately.

Mail or Fax: Submit Form SS-4 to your IRS service center. Processing takes 4 business weeks.

You'll need your LLC's legal name, principal address, and formation date.

What You Need to Know

Your Florida LLC and your EIN are separate. Florida issues your LLC certificate under Fla. Stat. § 605.0201; the IRS issues your EIN. You don't need an EIN to form your LLC in Florida, but you'll need it for federal taxes, hiring employees, and opening a business bank account.

Fictitious Name (DBA): If you operate under a different name, file a fictitious name registration with Florida for $50.00.

Timeline: Allow 1–2 weeks for Florida processing, then apply for your EIN immediately after approval.
